Wage Theft

Because Every Hour of Your Work Deserves Fair Pay

Fighting for Fair Compensation in San Diego Workplaces

At Vallero Law, we aggressively advocate for employees who have been denied their rightful wages by employers. Our San Diego-based practice handles both individual claims and class action lawsuits involving wage and hour violations throughout California.

California's Strong Wage Protections

California’s labor laws provide some of the nation’s strongest protections for employees’ wage rights. These laws reflect our state’s commitment to ensuring fair compensation and holding employers accountable for violations—protecting both workers and California’s economy. For proven violations, employers face substantial penalties beyond simply paying back wages.

Common Wage Violations We Address

Minimum Wage Violations

California’s minimum wage exceeds federal requirements, currently standing at $16.50 per hour for employers with 26 or more employees, and $15.50 for smaller employers. We help employees recover when employers:

  • Pay below minimum wage
  • Count tips toward minimum wage (prohibited in California)
  • Fail to pay for all hours worked
  • Make improper deductions

Overtime Violations

California’s overtime laws exceed federal protections, requiring:

  • 1.5× regular pay rate for hours worked beyond 8 in a day
  • 1.5× regular pay rate for hours worked beyond 40 in a week
  • 2× regular pay rate for hours worked beyond 12 in a day
  • 2× regular pay rate for work on the seventh consecutive day

Many employees are misclassified as “exempt” to avoid overtime payments. Vallero Law expertly analyzes job duties—not just titles or salary status—to determine if you’ve been wrongfully denied overtime compensation.

Meal and Rest Break Violations

California law entitles non-exempt employees to:

  • An uninterrupted 30-minute meal break for shifts over 5 hours
  • A second meal break for shifts over 10 hours
  • A 10-minute paid rest break for every 4 hours worked

When employers fail to provide these breaks or interrupt them with work duties, they owe penalty payments of one additional hour of pay per workday for each type of break violation.

Additional Wage & Hour Violations

  • Off-the-Clock Work: Requiring work before clocking in or after clocking out
  • Misclassification: Incorrectly designating employees as independent contractors
  • Reporting Time Pay: Failing to compensate employees who report to work but are sent home
  • Final Paycheck Violations: Delaying final wage payments after termination
  • Reimbursement Failures: Not covering necessary business expenses
