Understanding Your Equal Pay Rights
Both federal and California laws prohibit wage discrimination based on gender.
Federal Equal Pay Act of 1963
Establishes that employers cannot pay different wages to employees of opposite sexes for equal work requiring equal skill, effort, and responsibility performed under similar working conditions.
California Equal Pay Act (As Amended)
California’s protections go even further, limiting exceptions and creating stronger safeguards against pay discrimination.
What Constitutes Equal Work?
The law doesn’t require identical jobs—only substantially similar work. This means:
- Equal Skill: Similar experience, training, education, and ability requirements
- Equal Effort: Comparable physical or mental exertion
- Equal Responsibility: Similar degree of accountability
- Similar Working Conditions: Comparable surroundings and hazards
You Don't Need to Prove Intent
Unlike many discrimination claims, equal pay violations don’t require proving your employer intentionally discriminated. You must only demonstrate that:
- You were paid less than an employee of the opposite sex
- For substantially similar work
- Under similar working conditions
Know Your Rights to Discuss Wages
In California, you have the protected right to:
- Discuss your salary with coworkers
- Ask about others’ compensation
- Share your own wage information
- Help others exercise their equal pay rights
Your employer cannot legally prohibit these discussions or retaliate against you for having them.
